1 SCOPE OF APPLICATION & AMENDMENT OF TERMS OF SALE

The general terms and conditions of sale detailed below apply to all orders placed on the www.that-little-pink-shop.fr website.

These terms of sale are concluded, on the one hand, by the company MADAME PATRICIA ATTWOOD (RCS number A 378 036 057) and, on the other hand, by any non-professional individual wishing to make a purchase via the www.that-little-pink-shop.fr website, hereinafter referred to as the “consumer.”

The website www.that-little-pink-shop.fr and the brand That Little Pink Shop are entirely owned by MADAME PATRICIA ATTWOOD, as are all related rights. Any reproduction, in whole or in part, is systematically subject to the owners’ authorization. Any unauthorized use of the site or its content would constitute an act of infringement.

By “buyer,” we mean any individual who is not acting for professional purposes or in connection with business activity.

Any order implies the buyer’s full acceptance of these general terms and conditions of sale and, where applicable, of the specific conditions applied to one or more products. That Little Pink Shop reserves the right to modify its terms of sale at any time and without prior notice. In this case, the applicable conditions will be those in force on the date of the buyer’s order. The modifications will apply to all orders placed after these modifications.

In accordance with the provisions of articles 1369-1 et seq. of the Civil Code, the general terms and conditions of sale are made available in a manner that allows for their retention and reproduction. The buyer can print them or read them online.

2 ORDER & PRODUCT AVAILABILITY

The contract is concluded when That Little Pink Shop receives your order form electronically and once the accuracy of the order data has been verified.

Once the contract is concluded, That Little Pink Shop will process your order and send you an order receipt by email.

The customer follows the process below: – Cart validation – Choice of payment method

Payment: Credit Card or PayPal

Our products are, by definition, unique and remain available as long as they are visible on the site. In cases where multiple customers are interested in the same item, the first one to validate their cart acquires it. It then becomes “unavailable” for others. In the event of an exceptional stock management malfunction and product unavailability after the buyer’s order has been placed, That Little Pink Shop will notify the customer by email of a partial delivery or the cancellation of their order. If the buyer’s bank account has been debited, That Little Pink Shop will initiate an immediate refund procedure. The customer’s account will be credited again.

Vintage products are second-hand items, making them unique. Each product comes with a description provided by That Little Pink Shop. The catalog photographs are as accurate as possible but cannot guarantee a perfect similarity with the product offered, particularly concerning colors. Despite all the care taken in selecting items, we cannot avoid certain degradations due to time (minimal holes, stains, discolorations…).

These alterations, always discreet, are an integral part of the item’s history and charm. Accessories shown on models, if any (bags, shoes, jewelry, belts, or other accessories), are not sold with the described product and are used to illustrate an outfit.

That Little Pink Shop strives to combat counterfeiting and the sale of any prohibited products. However, if, despite our product authentication and certification process, the buyer acquires a counterfeit or prohibited product, That Little Pink Shop commits to refunding the customer and removing the product concerned.

3 PRICE

The prices of items for sale are expressed in euros.

The price indicated on the product pages does not include shipping. Shipping costs are borne by the buyer if the purchase amount is less than 200€; otherwise, shipping, packaging, and logistics costs are free. The price indicated in the order confirmation is the final price, including all taxes. 


That Little Pink Shop reserves the right to modify its prices at any time but undertakes to apply the prices indicated at the time of your order, subject to availability on that date.

4 PAYMENT METHODS

The price invoiced to the customer is the price indicated on the order confirmation sent by That Little Pink Shop. The price of the products is payable in full on the day the order is placed. Payments can be made via credit card or PayPal. Orders can also be paid for during in-person pickup at our physical shop at Marché Serpette (110 rue des rosiers 93400).

In all cases, the buyer will be debited within one week following order validation.

In case of late payment, we reserve the right to cancel the order within 8 days after the order date, and the item will be automatically put back on sale. Transaction tracking is recorded by That Little Pink Shop. Upon payment validation by That Little Pink Shop, the order becomes effective. In case of bank refusal, That Little Pink Shop will automatically cancel the current order.

That Little Pink Shop reserves the right to refuse or cancel an order from a customer with whom there is a dispute regarding payment for a previous order. Retention of Title Clause

In accordance with the provisions of the law of May 12, 1980, ordered products remain the property of www.that-little-pink-shop.fr until full payment of their price by the customer. In the event of the customer’s failure to fulfill their obligations, whatever the cause, That Little Pink Shop will be entitled to demand the immediate return of the products at the customer’s expense and risk.

The photos and all texts present on the www.that-little-pink-shop.fr website are the property of MADAME PATRICIA ATTWOOD and may not be used without prior authorization, under penalty of prosecution.

5 DELIVERY METHODS

After order confirmation, products will be sent to the delivery address indicated by the Buyer on their order form, within a maximum of 72 working hours. We strive to ensure delivery within 21 days. In case of difficulties, we commit to keeping you informed. Deliveries are made throughout France and internationally.

That Little Pink Shop uses La Poste services for shipments within France via Colissimo (delivery against recipient’s signature). Parcels handled by La Poste allow for delivery tracking.

Upon receipt of the package, it is the recipient’s responsibility to check the product’s conformity and to note any damage due to the carrier on the delivery slip. You have 48 hours to make any reservations with the carrier in case of damage.

In the event of proven damage, the buyer must file a complaint by registered letter with acknowledgment of receipt within seven days of receiving the package. The complaint should be sent to the following address: Mme Patricia Attwood, 8 square alboni 75016 Paris. The product must be returned via tracked Colissimo in its original condition to the Seller within the same timeframe; otherwise, the complaint cannot be accepted.

Return costs are borne by the Buyer. The buyer must then attach proof of shipping costs to the package.

That Little Pink Shop disclaims all responsibility for non-compliance with delivery times due to unforeseeable or insurmountable events caused by the carrier (particularly in cases of product loss or strikes).

6 RIGHT OF WITHDRAWAL

The product cannot be returned by the Buyer. The Buyer may cancel their order within a maximum of 1 day after placing the order, if delivery has not yet been made. Once the delivery process has been initiated, the product cannot be returned by the Buyer.

7 WARRANTIES

The products offered by That Little Pink Shop are second-hand items. They are described in detail, and their condition is evaluated according to the following criteria:

Excellent condition: The item has been worn very little and shows no significant defects.
Very good condition: The item shows normal signs of use and remains of very good quality.
Good condition: The item shows undeniable signs of use, may have small defects, but the garment remains perfectly wearable.

Items sold on the That Little Pink Shop website are thoroughly examined.
We systematically discard torn or stained garments. Noted restorations are indicated.

Despite the care taken, a small defect such as a stretched seam, loose or missing stitches may escape our notice…

Characteristics of the goods and services offered: the images and colors of the products for sale on www.that-little-pink-shop.fr may not correspond to the actual colors due to the internet browser and screen used.

Care & Cleaning: Some old fabrics are delicate and must be handled with great care. We advise against using washing machines and associated drying systems for the care of vintage clothing in general.

We recommend consulting a specialist dry cleaner.

8 DATA PROTECTION AND FREEDOMS

In application of the law of 11/03/1957 [art. 41] and the intellectual property code of 01/07/1992, any partial or total reproduction of the information contained on this site is strictly prohibited. The logos, visuals, and documents present on the www.that-little-pink-shop.fr website are the property of their respective owners.

Responsibility:

The seller, in the online sales process, is bound only by an obligation of means; their responsibility cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.

These online terms of sale are subject to French law. In case of dispute, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or third-party claims.
